How it is calculated

  1. Days short = notice days required − notice days served.
  2. Daily wage = total monthly wage ÷ 30.
  3. Allowance = days short × daily wage (Article 43, clauses 3 and 4).

The law says the allowance equals the worker's wage for the whole notice period or the part not served, based on the last wage received. It does not give the monthly-to-daily conversion, so we divide by 30, the usual convention.

Frequently asked questions

How long is the notice period in the UAE?expand_more

It is agreed in your contract and must be at least 30 days and at most 90 days (Article 43, clause 1). The period must be the same for both sides unless a longer period works in the worker's favour.

Am I paid during the notice period?expand_more

Yes. The contract stays in force during notice and you are entitled to your full wage for that period, based on the last wage you received. Your employer can ask you to work during it (Article 43, clause 2).

What happens if I do not serve the full notice?expand_more

The side that does not keep to the notice pays the other a notice allowance equal to the worker's wage for the whole notice period, or the part not served. It is due even if the other side suffered no loss (Article 43, clause 3).

Is the allowance based on basic salary or total salary?expand_more

On the wage you last received. The law defines "wage" as the basic wage plus cash allowances and benefits (Article 1), so use your total monthly wage here. Gratuity and leave payouts use basic salary only, but the notice allowance does not.

Can my notice period be shortened or waived?expand_more

Yes, by agreement. You and your employer can agree to exempt the notice or shorten it, as long as all your rights for the agreed notice period are kept (Article 43, clause 2).

What is the notice during the probation period?expand_more

Probation can last up to six months. During it, your employer can end the contract with at least 14 days' written notice. If you want to leave the UAE you give at least 14 days. If you want to move to another employer in the UAE you give at least one month, and the new employer compensates the old one for recruitment costs unless agreed otherwise (Article 9).

Do I get time off to look for a job if my employer ends the contract?expand_more

Yes. During the notice period you have the right to be absent one unpaid working day a week to look for another job, and you choose the day if you tell your employer at least three days before (Article 43, clause 5).
