How it is calculated
- Daily wage = total monthly wage ÷ 30. The law says "wage" includes cash allowances, but does not give the divisor, so dividing by 30 is the usual convention.
- Sick leave after probation: days 1 to 15 at full pay, days 16 to 45 at half pay, days 46 to 90 unpaid (Article 31, clause 3).
- Sick leave in probation: unpaid (Article 31, clause 2).
- Maternity leave: days 1 to 45 at full pay and days 46 to 60 at half pay (Article 30, clause 1).
- Pay for the period = full-pay days × daily wage + half-pay days × daily wage × 0.5.
The 90 days are counted per year and can be taken in several spells, so add up every sick day in the year. The law does not say which 12 months count (calendar year or from your start date), so check your contract.
