How UAE gratuity is worked out
Gratuity is based on your last basic salary and your length of continuous service (Article 51). To convert a monthly salary into a daily wage we divide it by 30, the usual convention.
- 1
Less than one year
No gratuity is due if you have not completed one year of continuous service.
- 2
First five years
21 days of basic wage for each year of service. Part of a year counts in proportion (Article 51, clause 3).
- 3
Beyond five years
30 days of basic wage for each year after the fifth.
- 4
Maximum
The total cannot be more than two years of basic wage (24 months of basic salary).
Formula: gratuity = (21 × years up to 5 + 30 × years beyond 5) × (basic monthly salary ÷ 30)
Examples
- • Basic salary: AED 10,000.00 a month
- • Daily wage: 10,000.00 ÷ 30 = AED 333.33
- • Gratuity days: 63.00
- • Basic salary: AED 18,000.00 a month
- • Daily wage: 18,000.00 ÷ 30 = AED 600.00
- • Gratuity days: 165.00
- • Basic salary: AED 3,000.00 a month
- • Daily wage: 3,000.00 ÷ 30 = AED 100.00
- • Gratuity days: 855.00
- • Capped at 24 months of basic salary
Frequently asked questions
Is gratuity calculated on total salary or basic salary?expand_more
On basic salary only. Article 51 says gratuity is calculated on the basic wage, specifically the last basic wage you received. Housing, transport and other allowances, bonuses and commission are not included.
How long must I work to get gratuity?expand_more
At least one year of continuous service (Article 51). Below one year, no gratuity is due.
Does a part of a year count?expand_more
Yes. Once you have completed one year, the law gives you gratuity for parts of a year in proportion to the time you worked (Article 51, clause 3). This calculator counts your exact days.
Is there a maximum amount?expand_more
Yes. The total gratuity cannot exceed two years of wage, which this calculator applies as 24 months of basic salary (Article 51, clause 6).
Are unpaid leave days counted as service?expand_more
No. Days of absence without pay are not included in the period of service (Article 51, clause 4). Enter them in the calculator and they are subtracted.
Does resigning reduce my gratuity?expand_more
Article 51 does not reduce gratuity for resignation. It sets one formula for foreign full-time workers whose service ends. Even dismissal as a disciplinary sanction is described in Article 39 as keeping the worker's right to gratuity. If your case involves a dispute, ask MOHRE or a qualified adviser.
When must my employer pay it?expand_more
Within 14 days of the end of the contract, together with your wages and other entitlements (Article 53).
Can my employer deduct from my gratuity?expand_more
Only amounts due under the law or a court judgment (Article 51, clause 7). The Executive Regulations (Article 29) list them: unpaid loans or overpayments, pension and insurance contributions owed, penalties under the approved penalty list, court debts, and damage you caused through error or by ignoring instructions.
Does this apply to everyone?expand_more
This calculator is for foreign full-time workers. UAE nationals get end of service benefits through the pension and social security system (Article 51, clause 1). Part-time and job-sharing workers get a proportion based on contracted hours, and temporary workers or anyone under one year get none (Executive Regulations, Article 30).
